The following terms and conditions (“Terms”) govern your use of the Craftsy.ie website (“the Website”) and the purchase of products from vendors (“Vendors”) through the Website. Please read these Terms carefully before you start to use the Website or make a purchase. By using the Website, you agree to be bound by these Terms.
1. Introduction
Craftsy.ie is an online marketplace platform that allows independent vendors to offer and sell their craft products directly to customers. Please note that Craftsy.ie is not the seller of the products available on the Website, but acts as an intermediary in the transactions between buyers and Vendors.
2. Using the Website
To make purchases on Craftsy.ie, you may be asked to create an account. You are responsible for maintaining the confidentiality of your account details and password and for all activities that occur under your account. You must be 18 years or older to use our Services. Minors under 18 and at least 13 years of age are only permitted to use our Services through an account owned by a parent or legal guardian with their appropriate permission and under their direct supervision.
3. Placing Orders and Payments
By placing an order, you are paying for a product on the terms and conditions set by the Vendor. All orders are subject to acceptance by the Vendor. Payments for orders are processed through secure payment gateways. You agree to provide current, complete, and accurate purchase and account information for all purchases made on our Website.
4. Pricing and Availability
Product prices are set by the Vendors and are subject to change without notice. We make every effort to ensure the accuracy of product information and availability, however, we cannot guarantee that all information is free from errors. In the event of an error in the price or description of a product, the Vendor reserves the right to cancel the order.
5. Shipping and Delivery
Vendors are responsible for shipping the products you order. Delivery times and costs vary depending on the Vendor and the delivery location. Vendors should dispatch items within their stated processing time, and delivery should be to the address provided by the buyer at the time of purchase. Under the Consumer Rights Directive, if a specific delivery date is not agreed upon, the product should be delivered within 30 days of purchase.
6. Returns and Right to Withdraw
In accordance with Irish and EU law, you have the right to withdraw from an online purchase contract within 14 days of receiving the goods, without giving a reason (the “cooling-off period”).[1][2] To exercise this right, you must inform the Vendor of your decision. The cost of returning the goods may be borne by the buyer, provided the Vendor informed you of this before the purchase.[1]
If the goods you receive are faulty, not as described, or not fit for purpose, you have rights under the Sale of Goods and Supply of Services Act, 1980. In such cases, you should contact the Vendor to arrange for a repair, replacement, or refund.
7. Liability
Craftsy.ie is not responsible for the quality, safety, or legality of the products sold on the platform.[3] The responsibility for the products rests solely with the Vendors.[3] Our role is limited to facilitating the transaction between buyers and Vendors.[3][4]
8. Intellectual Property Rights
All content on the Website, including trademarks, logos, and images, is the property of Craftsy.ie or the Vendors and is protected by intellectual property law. Their use is prohibited without prior written consent.
9. Data Protection
We respect your privacy. The rules for collecting, using, and protecting your personal data are set out in our Privacy Policy, which is an integral part of these Terms. In accordance with the General Data Protection Regulation (GDPR), personal data may only be stored for as long as is necessary for the purposes for which it was collected.
10. Dispute Resolution
In the event of a dispute with another user of the Services, we encourage you to contact the other party and attempt to resolve the dispute amicably. If you are unable to resolve a dispute with a Vendor on your own, you may contact Craftsy.ie customer support for assistance. By law, sellers or suppliers must treat you fairly.
11. Changes to the Terms
We reserve the right to change these Terms at any time. Any changes will become effective upon their publication on the Website. Your continued use of the Website after the changes have been made constitutes your acceptance of them.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of Ireland. Any disputes arising from these Terms will be settled by the courts of Ireland.
